For the U.S. vaping industry, the past 12-months have been horrific. Countless vaping product retailers and many e-liquid manufacturers have shuttered operations in the wake of the so-called epidemic of teen vaping, the CDC’s outright deception over the so-called vaping-related lung illness and following the economic destruction resulting from the COVID-19 pandemic lockdown.
Now with just a little over a month left to meet the final deadline for the U.S. Food and Drug Administration’s Premarket Tobacco Product Application process; the U.S. vaping industry is bracing for yet another purge, which could destroy vaping as we know it in America.
In this episode of RegWatch we are joined by Amanda Wheeler, President of the Rocky Mountain Smoke Free Alliance and Executive Director of the Arizona Smoke Free Business Alliance. Advocating on behalf of small manufacturers of non-cartridge ENDS products, Wheeler has been in direct discussion with officials at the United States Department of Health & Human Services, FDA and the Trump White House.

*Guest: Dr. Chris Lalonde Professor of Psychology, University of Victoria - When University of Waterloo professor David Hammond first shared preliminary results of his teen vaping and smoking study with Health Canada and the media in late 2018, he did so with the “hope” that his findings were just a “blip”; a sentiment he expressed at the time, and then again in June 2019 when the study was finally published in the British Medical Journal.
While the results of the survey showed a 74% increase in teen vaping (measured as used once in the past 30-days,) from 2017 to 2018, the most explosive finding was in regard to youth smoking.
Dr. Hammond’s research purported to find a massive year-over-year increase of 45% in the prevalence of smoking among youth ages 16 to 19 in Canada. The finding fueled national news coverage, hyping the teen vaping “epidemic” and bolstered the claim that vaping is a gateway to smoking.
Now one year later, Dr. Hammond and the British Medical Journal have issued a correction to the controversial study and admit that not only was there no increase in teen smoking; the rate fell by 7%.
Joining us today on RegWatch is Dr. Chris Lalonde, Professor of Psychology and expert in research methodology at the University of Victoria. Hear his assessment of how researchers, media, and regulators leveraged Hammond’s research to justify new restrictions on vaping products; and learn why he believes this is a “pivotal moment.”

The VERITAS (Vaping effects: real-world international surveillance) Cohort Study is headed by Dr. Riccardo Polosa out of CoEHAR, the Center of Excellence for Harm Reduction, Catania. The lead scientist and global project manager is Dr. Carl V. Phillips.

*Guest: Sam Tam, President of the Canada Vaping Association - In the effort to stem youth use of vaping products, Health Canada announced its final Vaping Products Promotion Regulations, which set out measures to further restrict the advertising and promotion of vaping products to youth. Central to the government’s approach is a strict requirement to display “health warnings” on all vaping products, promotions, and point of sale materials.
While overall the new regulations are welcome by industry, it’s becoming increasingly difficult for stakeholders to accept, what may be considered as the “original sin” of the Tobacco and Vaping Products Act; the enshrinement of vaping as a “health hazard,” rather than as a tool for harm reduction.
The notion that vaping is a “health hazard” imbues the regulatory framework and nowhere does one find a comparison of the potential health benefits of vaping to the known dangers of smoking—what is hazardous to health could never provide a health benefit, so the argument goes.
Joining us today on RegWatch is Sam Tam, President of the Canadian Vaping Association. Hear his thoughts on Health Canada’s latest round of regulations and learn what the impact could be on Canada’s $1.36 billion vaping industry.

It was a surprise decision issued by Australia’s Minister of Health to ban the personal importation of liquid nicotine for vaping beginning on July 1. The order was issued on June 19, leaving little time for harm reduction activists and a coalition of MPs to mount an effective challenge to a law, which many agree, could drive tens of thousands of vapers back to smoking.
Under growing pressure, Health Minister Greg Hunt decided on June 27 to delay the ban on importing nicotine. However, the fight to legalize vaping is far from over.
Joining us today on RegWatch is Dr. Colin Mendelsohn, Founding Chairman of the Australian Tobacco Harm Reduction Association and member of the Expert Advisory Group that develops the Australian national smoking cessation guidelines.
