Tobacco harm reduction is a concept never discussed in prison, despite the toll smoking takes on inmates’ health and the lack of safer alternatives behind bars. But for those exiting the prison system, they find a new freedom in the plethora of safer nicotine options, including vaping, which offer a path to better health and control over their finances and well-being.

Today, the U.S. vaping industry finally had its day before the United States Supreme Court. In this episode of RegWatch, we bring you key moments from today’s landmark Supreme Court session and critical reactions from vape industry attorney Greg Troutman and Jim McCarthy of the American Vapor Manufacturers Association.

Is TRUMP’S Pick For SURGEON GENERAL Good For Vaping? | RegWatch
Sunday Nov 24, 2024
Sunday Nov 24, 2024
As reported by Politico, President-elect Donald Trump announced Friday that Dr. Janette Nesheiwat is his choice to serve as Surgeon General in his new administration.
Dr. Nesheiwat is a Fox News medical contributor and currently serves as medical director at CityMD, a network of urgent care centers in New York and New Jersey.
“Dr. Nesheiwat is a fierce advocate and strong communicator for preventive medicine and public health,” Trump said in a statement. “She is committed to ensuring that Americans have access to affordable, quality healthcare and believes in empowering individuals to take charge of their health to live longer, healthier lives.”
But is Dr. Nesheiwat the right choice for vaping advocates? In 2019, as part of her role at Fox News, she issued a stark warning about vaping, linking nicotine e-cigarettes to the outbreak of deadly lung illnesses—a claim later debunked and attributed to black market THC vapes. Her report played a significant role in fueling early fears about vaping’s safety.

POLICY FRICTION | Special Interest NGO’s Behind Push to Ban Flavours | RegWatch
Thursday Nov 14, 2024
Thursday Nov 14, 2024
A coalition of anti-smoking special interest groups has brazenly crossed from advocacy into coercion, demanding a nicotine flavor ban that threatens to crush Canada’s $2 billion vaping industry and potentially push many of the country’s 1.9 million adult vapers back to smoking.
In a concerning display of political muscle, these groups—Physicians for a Smoke-Free Canada, Action on Smoking & Health Canada, and the Quebec Coalition for Tobacco Control—held a press conference in Ottawa this October, delivering an ultimatum to Addictions Minister Ya'ara Saks: impose a national flavor ban or resign.
This ultimatum shatters the norms of public health advocacy, raising serious questions about the agenda and ethics behind such pressure tactics.
Joining us today to discuss these troubling developments is Sam Tam, president of the Canadian Vaping Association. Learn more about this unprecedented demand, the implications for Canada’s vaping industry, and how the industry is fighting back.

CRUNCH TIME | Will the Next President Save Vaping? | RegWatch
Wednesday Oct 30, 2024
Wednesday Oct 30, 2024
With only days remaining in the 2024 U.S. presidential race, it’s crunch time for the candidates—and for nicotine vape consumers and the businesses that drive the U.S. vaping industry. One candidate, former President Donald Trump, announced in September that he "saved vaping" in 2019 and vows to do it again if elected to a second term. Yet, some remain unconvinced, given Trump’s mixed record on vaping.
In contrast, Vice President Kamala Harris has no personal track record on vaping, but the Democratic Party certainly does—and much of it is concerning for the industry. Flavor bans, teen vaping hysteria, misinformation, and distorted science have characterized the Democratic stance on vaping. Would a Harris presidency lead to a turnaround in the party and potentially at the FDA?
Joining us today to unpack the promises and pitfalls of each candidate is Tony Abboud, Executive Director of the Vapor Technology Association.
Will the next U.S. president save vaping?

GAGGED | Vape Industry Fights FDA Speech Restrictions | RegWatch
Friday Oct 25, 2024
Friday Oct 25, 2024
Prohibition haunts the U.S. vaping industry, putting millions of lives at risk. Beyond the flavor bans and moral panics, the most damaging restriction is the FDA’s sweeping ban on speech. U.S. vape manufacturers and retailers are legally forbidden from sharing essential truths about nicotine vaping products—that they’re vastly safer than cigarettes and can help people quit. The FDA itself admits these facts yet forbids the industry from sharing them.
Joining us today to discuss groundbreaking litigation to overturn the FDA’s commercial speech restrictions is Jim McCarthy, President of Counterpoint Strategies and agency of record for American Vapor Manufacturers. The goal? To secure the right to tell the truth about vaping.

HABIT FORMING | How Big Tobacco Spoiled Our Food | RegWatch
Thursday Oct 10, 2024
Thursday Oct 10, 2024
It’s surprising to learn that the largest food companies in the world were once owned by big tobacco. During the 1980s through the early 2000s, tobacco giants Philip Morris and R.J. Reynolds acquired and operated Kraft, General Foods, and Nabisco, generating billions in revenue from well-known brands like Oreo cookies, Kraft Macaroni & Cheese, and Lunchables.
When big tobacco controlled these food giants, rates of obesity, diabetes, and other diet-related diseases surged across the West. This has led many to ask: Did big tobacco apply its expertise in making cigarettes more addictive to the engineering of processed foods?
Joining us today to explore this question is Dr. Tera Fazzino, Associate Director of the Cofrin Logan Center for Addiction Research and Treatment at the University of Kansas. Her ground-breaking research into “hyper-palatable” foods sheds light on how big tobacco may have spoiled the American food supply.
Did big tobacco make food addictive?

British American Tobacco is one of the oldest and largest of the world's tobacco companies. But they are also among the most innovative. Through its U.S. subsidiary, R.J. Reynolds, BAT was the first to receive marketing authorization from the FDA through the PMTA process for the Vuse Solo e-cigarette and tobacco-flavored e-liquid pods. This marked a significant milestone for the industry.
Joining us today to discuss the challenges of the FDA’s PMTA process, the importance of science, and the contentious battle over THR is Elaine Round, the Group Head of Life Sciences at BAT. Hear about BAT’s commitment to tobacco harm reduction and concerns over misperceptions of harm.

CRUCIAL DECISION | Supreme Court to Review FDA Errors | RegWatch
Saturday Sep 21, 2024
Saturday Sep 21, 2024
The U.S. vaping industry faces a pivotal moment as the Supreme Court prepares to review a Fifth Circuit Court of Appeals decision. This ruling overturned FDA Marketing Denial Orders, including those affecting Triton Vapes LLC, seeking authorization to sell flavored nicotine vaping products.
A favorable ruling could not only overturn these denials but also potentially unravel the FDA’s authority over vape sales entirely.
Today, attorney and long-time vaping advocate Greg Troutman joins us to analyze this critical SCOTUS hearing. Could this be the end of the vaping industry’s relentless regulatory battle?
